We at ETwater believe that protecting your privacy is important and have created this privacy policy to describe our information gathering and dissemination practices. By using our website, you explicitly consent to our use of your information as described in this privacy policy. This privacy policy is effective as of November 12, 2004.
Changes to this Privacy Policy
We may update this privacy policy from time to time and will post such updates on our website. If we make any material change to the way in which we treat your personal information, we will inform you of such change via e-mail or by posting a notice on relevant areas of our website. Any updated version of this privacy policy will be effective as of the date set forth therein.

When you activate your ETwater service account, you will be asked to provide certain information about yourself (e.g., personally identifiable information such as your name, address, telephone number, credit card information), information about your smart controller (e.g., model type, serial number), and information about the area served by the irrigation system controlled by your smart controller (e.g., irrigation method, soil type, plant type). We use such information to provide you with the ETwater service, to conduct and confirm billing activities, to monitor usage of the ETwater service, to customize our website, and to contact you from time to time about us, our website, and our products and services. We will also use any information you provide to us about someone other than you in the same manner that we use your own information.

We automatically collect certain information to help us understand how our customers use the ETwater service and our website. For example, each time you visit our website we automatically collect your IP address, browser and computer type, access time, the webpage from which you came, and the webpage(s) that you access during your visit. We also use cookies (which are small amounts of data sent from a web server to your browser that are stored on your computer's hard drive) to assist us in the analysis of how users use our website. In addition, third parties who we permit to place advertisements on our website may also collect information through cookies to ensure that their advertising systems and technologies work properly and to allow them to track responses to their advertisements. Cookies set by these third parties are governed by the privacy policies of those third parties. Generally, you can set your browser not to accept cookies or to notify you if you are sent a cookie, giving you the opportunity to choose whether or not to accept the cookie. Please note that if you do set your browser not to accept cookies, some parts of our website may not operate properly.
Our Information Sharing Practices
Service Providers. From time to time, we may enter into relationships with third parties who provide services to us (e.g., credit card processing services, shipping services, data management and storage services). In those circumstances, we disclose information about you that is necessary for such service providers to perform those services, but only if such service providers agree not to disclose your information except as necessary to perform such services.
Third-Party Marketers. In addition, from time to time we may (1) share information about you with third parties so they may contact you regarding goods or services in which you may be interested, and (2) combine information we receive from third parties with information we have collected about you or that you have submitted to make our future marketing efforts more efficient.
Other Disclosure Scenarios. Notwithstanding anything in this privacy policy to the contrary, we reserve the right, unless limited by applicable law, to share any information we have collected about you or that you have submitted: (1) in response to subpoenas, court orders, or legal process; (2) to establish, protect, or exercise our or our customers' rights or to defend against claims; (3) if we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, fraud, or situations involving potential threats to the safety of any person or property; (4) if we believe it is necessary to investigate, prevent, or take action regarding situations that involve misuse of our website or the ETwater service; (5) to our parent company, subsidiaries, joint ventures, or other companies under common control with us (in which case we will require such entities to honor this privacy policy); and (6) if we or substantially all of our assets are acquired by or merged with another entity or entities (in which case we will require such entity or entities to honor this privacy policy).
Choice/Opt-Out
We offer you the opportunity to (1) choose not to receive communications from us, and (2) request that we not share your information with third parties. If you would like to take advantage of either (or both) of those opportunities, please let us know by updating your profile on our website. Please note that sometimes these requests may take up to ten business days to process and that we are not responsible for removing information about you from the database of any third party with whom we shared your personal information prior to processing your request. Even if you do take advantage of these opportunities, we reserve the right to send you administrative messages relating to the our website (e.g., about changes to this privacy policy), to contact you regarding your ETwater service account and/or the operation of your smart controller, to share your information with our service providers, and to share aggregated information about you and your use of the ETwater service with third parties in a manner that would not permit the recipient of such aggregated information to personally identify you.
Accessing, Correcting, and Deleting Your Information
If you would like to modify or delete from our database any personal information you previously submitted to us, please let us know by accessing and updating your profile on our website. Please note that sometimes these requests may take up to ten business days to process, that any information about you that we have copied may remain in back-up storage for some period of time after your request, and that if you delete certain information (e.g., your billing address or credit card number) you may not be able to continue to receive the ETwater service. Also, please note that we will maintain information about you in our database whenever we are required to do so by law.
Security
We have implemented reasonable security measures to protect your personal information. Unfortunately, however, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your information, you acknowledge that (1) there are security and privacy limitations of the Internet which are beyond our control, (2) the security, integrity, and privacy of any and all information exchanged between you and us through our services cannot be guaranteed, and (3) any such information and data may be tampered with by a third party. We urge you to keep your password in a secure place, not to divulge it to anyone, and to sign off of our website and close your browser when you have finished visiting our website.
