Limited Warranty Statement

LIMITED WARRANTY

ETwater Systems, LLC ("ETwater") warrants that any ETwater hardware product will be free from defects in materials and workmanship under normal use for a period of three (3) years after the date of purchase. Your sole and exclusive remedy and ETwater's entire liability under this warranty is, at ETwater's option, either (i) repair of the product, (ii) replacement of the product, or (iii) refund of the purchase price of the product (as evidenced by a copy of your purchase receipt), less any rebates or credits.

EXCLUSIONS

The above mentioned warranty shall not apply (i) if the product has been altered or modified without ETwater's authorization, (ii) if the product has not been installed, operated, repaired, or maintained in accordance with ETwater's instructions, (iii) if the product has been subjected to abnormal physical, thermal, or electrical stress, or to misuse, neglect, or accident, or (iv) if product failure occurs as a result of any cause not attributable to ETwater.

WARRANTY SERVICE PROCEDURES

You must notify ETwater (by contacting us at 1-888-685-5505) of any defect in the product within the applicable warranty period and provide dated proof of original purchase prior to the return of the product. Within ten (10) business days after the date of notification, ETwater will provide you with a Returned Goods Authorization ("RGA") number and the location to which you must return the product. You are responsible for proper packaging of the product returned to ETwater, shipment to ETwater's designated location, and return of the product within ten (10) business days after issuance of the RGA number. ETwater does not accept responsibility for any product lost in transit and recommends that the return be insured for the full value of the product. Transportation costs relating to warranty service and any applicable duties will be borne by you. If a warranty claim is invalid for any reason, ETwater will contact you.

EXCEPT AS SPECIFIED ABOVE, ALL EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS, AND WARRANTIES INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, NON-INFRINGEMENT, OR ARISING FROM A COURSE OF DEALING, USAGE, OR TRADE PRACTICE, ARE HEREBY EXCLUDED TO THE EXTENT ALLOWED BY APPLICABLE LAW.

LIMITATION OF LIABILITY

IN NO EVENT WILL ETwater OR ITS AFFILIATES OR SUPPLIERS BE LIABLE FOR ANY LOSS OF USE, INTERRUPTION OF BUSINESS, LOST PROFITS, OR LOST DATA, OR INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF ETwater OR ITS AFFILIATE OR SUPPLIER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE, AND WHETHER OR NOT ANY REMEDY PROVIDED SHOULD FAIL OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM JURISDICTION TO JURISDICTION.
